Duncan has over 30 years’ experience of successfully conducting a range of often complex and demanding commercial and private disputes in the English and foreign courts, and contractual and debt disputes.
Many cases have been successfully resolved through informal means, by mediation or roundtable meetings without the need to go to trial or even to issue legal proceedings at court. This requires experience and the careful preparation of the client’s case to strengthen its hand at the negotiating table to secure the best result.
Duncan’s practice includes obtaining and defending injunctions, sometime urgently and enforcement of judgments against UK and overseas assets.
Acting for third party interveners in urgent intervention and achieving a landmark result across Europe, heard in the Grand Chamber of the European Court of Human Rights (A, B and C v. Republic of Ireland 2011).
